Case Study

Meet Mr. Benson, a pollution claimant. Prevailing winds while on a journey to Nigeria have caused MV AMIDU, a 25 year old tanker with grt 100,000 to break into two and spill its cargo and bunkers 210 nautical miles off the Ghanaian coast. The spilled cargo and bunker have been driven by the currents towards the Ivorian and Ghanaian coasts.

Mr. Benson who owns a chain of hotels along the Ghanaian coast as well as some interests in the fishing industry has been affected directly by the spillage. The owners of MV AMIDU, ‘JOS SHIPPING’, a Nigerian company owns a second ship named MV IKECHUKU presently at the Tema Port.

Mr. Benson has employed the services of Masser Afrique for advice on the avenues of redress available to him.

With our comprehensive knowledge on Law of the Marine Environment, Mr. Benson was advised on;

• The jurisdiction for pollution damage.
• The applicable legal provision.
• The applicable time bar.
• The applicable limitation of liability.
• The possibility of enforcement measures in support of his claim.
• The rights of any defendant in limiting liability for oil pollution.

Based on our expert advice, Mr. Benson is now equipped with sufficient knowledge of his prospects of recovering damages in respect of all aspects of his claim. He has also recommended our services to the Government of Ghana on security measures that can be undertaken as well as their prospects of recovery.

Think Smart, be like Mr. Benson.
